The Department of Justice (DOJ) has conducted internal investigations into its handling of Jeffrey Epstein's cases, revealing significant lapses and raising questions about the department's efficacy and accountability. In 2020, the DOJ's Office of Professional Responsibility (OPR) examined the 2006–2008 federal criminal investigation by the U.S. Attorney’s Office for the Southern District of Florida. The OPR found that while former U.S. Attorney Alexander Acosta exercised "poor judgment" in negotiating a non-prosecution agreement with Epstein, his actions did not constitute professional misconduct. This conclusion has been criticized for downplaying the severity of the prosecutorial decisions that allowed Epstein to evade more serious federal charges, thereby failing his numerous victims.

Further scrutiny emerged following Epstein's death in 2019 while in custody at the Metropolitan Correctional Center in New York. A 2023 report by the DOJ's Office of the Inspector General (OIG) attributed his suicide to a "combination of negligence and misconduct" by the Bureau of Prisons staff, including severe staffing shortages and disregard for established protocols. Despite these findings, the DOJ's response has been perceived as inadequate, with limited accountability measures implemented. Critics argue that the department's internal investigations expose systemic failures yet fall short in enacting meaningful reforms to prevent future lapses, thereby undermining public trust in the justice system's ability to oversee high-profile detainees effectively.
