The proposed TAKE IT DOWN Act (S. 4569) aims to combat the spread of nonconsensual intimate visual depictions and digital forgeries. It seeks to amend the Communications Act of 1934 by establishing criminal prohibitions for intentionally sharing such content, especially with the intent to harm. Furthermore, the Act mandates that covered platforms implement a notice and removal process for these depictions within 48 hours of a valid request. The Federal Trade Commission would be responsible for enforcing these notice and takedown obligations.
